TERMS AND CONDITIONS
  1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this game is deemed acceptance of these Terms and Conditions.
  2. Entry is open to everyone aged 16 years or over. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the project to enter into a further agreement as evidence of consent to the minor entering this game.
  3. Employees (and their immediate families) of the project and agencies associated with this game are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  4. Game commences at 11:00AM EST on 19/01/2023 at the time the mint opens and will close once the correct guess has been made. (“Game Period”).
  5. To enter, individuals must undertake the following steps during the Game Period:
    1. Mint a character via mrdrvrs.com
    2. Once the mint has closed, the team will begin releasing clues via the official Twitter account @MRDRVRS.
    3. Clues will be released in a number of formats, including but not limited to: text, imagery, hidden in owned assets (contract and website source code) and audio. Players are tasked to decipher the clues and submit their guess via the tokengated web-app on who they believe the murderer is.
    4. There’s a catch: in order to submit a guess, players must burn an NFT in the process. Once guessed, the team will review all submissions and the first person to guess the murderer correctly will take
    5. To ensure fair game play, the token ID of the murderer, the accomplices and the bounties will be uploaded via a provenance hash and added to the contract. At the conclusion of the game, the token ID will be revealed.
  6. Game conclusion is defined as the period in which the murderer has been found.
  7. The project reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the project has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the game. Errors and omissions may be accepted at the project’s discretion. Failure by the project to enforce any of its rights at any stage does not constitute a waiver of those rights. The project’s legal rights to recover damages or other compensation from such an offender are reserved.
  8. Incomplete or indecipherable entries will be deemed invalid.
  9. The number of times a player can guess depends on how many MRDRVRS NFTs they own. For example 5 NFTs = 5 guesses. Players can guess only once at a time unless otherwise advised by the MRDRVRS team.
  10. If there is a dispute as to the identity of an entrant, the project reserves the right, in its sole discretion, to determine the identity of the entrant.
  11. The winner is determined by the first player to guess the token IDs correctly OR by holding holding the NFT of the murderer in the players wallet. This is a game of skill and chance plays no part in determining the winner.  Each entry will be validated by correctly guessing against the game question “who killed the Queen”. The first person to correctly select the TOKEN IDs will be determined as the winners.
  12. The project’s decision is final and no correspondence will be entered into.

Prize details for winning MRDRVRS SZN 1

  1. Total prize is 25% of mint. With an estimated minimum value of $49,800 USD at the current value of Ethereum being $1557 USD as of September 1, 2022.
  2. If for any reason the winner does not take the prize (or an element of the prize) at or by the time stipulated by the project, then the prize (or that element of the prize) will be forfeited.
  3. If the prize (or part of the prize) is unavailable, the project, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
  4. The prize, or any unused portion of the prize, is not transferable or exchangeable and will be awarded to the digital asset wallet that is connected for Game Play. 
  5. Entrants agree that they are fully responsible for any materials they submit via the game including but not limited to comments, recordings and images (“Content”). The project shall not be liable in any way for such Content to the full extent permitted by law. The project may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:
    1. they will not submit any Content that is unlawful or fraudulent, or that the project may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
    2. their Content shall not contain viruses or cause injury or harm to any person or entity;
    3. they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
    4. they will obtain full prior consent from any person who has jointly created or has any rights in the Content to the uses contemplated by these Terms and Conditions, and the Content does not infringe the rights of any third party;
    5. they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
    6. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

Without limiting any other terms herein, the entrant agrees to indemnify the project for any breach of the above terms.

  1. As a condition of entering this game, each entrant licenses and grants the project, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future gameal, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
  2. Entrants consent to the project using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this game (including any outcome), and promoting any products manufactured, distributed and/or supplied by the project.
  3. If this game is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the project, including but not limited to technical difficulties, unauthorised intervention or fraud, the project reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the game, as appropriate.
  4. Any cost associated with accessing the game’s website is the entrant’s responsibility and is dependent on the Internet service provider used.
  5. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the project (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the project’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the project) due to any reason beyond the reasonable control of the project; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
  6. The winner must declare and pay any taxes that are due in their respective country of tax residence, MRDRVRS and their partners will not do this on behalf of the winner(s).
  7. As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the project and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. In the event a winner is under the age of 18, a nominated parent/legal guardian of such a person will be required to sign the legal documentation required under this clause on their behalf.
  8. The project collects personal information (“PI“) in order to conduct the game and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this PI. The project will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.mrdrvrs.com/privacy. In addition to any use that may be outlined in the project’s Privacy Policy, the project may, for an indefinite period, unless otherwise advised, use the PI for game, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of Privacy Principles or any other applicable law and how those complaints will be dealt wit

NFT TERMS OF SALE
When you (Purchaser, you) purchase a MRDRVRS NFT (non-fungible token) from MRDRVRS (MRDRVRS, us, we), you agree to the terms and conditions per this document (Terms) and the license to these these NFT Terms (License). These apply to you and any persons who purchase the NFT(s) from you. All NFTs purchased by you from us are subject to the Terms and License. By purchasing you are bound by these terms and License.
  1. We may list NFTs for sale as part of the MRDRVRS brand. These may be part of a bundle of other digital goods or sole NFTs.
  2. Orders are non-refundable and cannot be canceled for change of mind.
  3. Orders require payment in full via the connection of a Digital Wallet of your choosing so long as it’s compatible with our smart contract on the Ethereum blockchain, for the NFT to be delivered.
  4. We are not responsible for the secondary sale of your NFT via a third party platform or blockchain. We are not responsible for additional transaction fees determined by these third parties.
  5. Secondary sale royalties will be paid to the company to the amount of 7.5%.
  6. Risk & title for the NFT purchase transfers to you once purchased. You are responsible for the security, accurate linking and storage of passwords or private keys for your digital wallet. If these are lost we cannot recover any of this information on your behalf.

  1. We own all legal right, title and interest in the intellectual property rights for the following:
    1. Art
    2. Concept
    3. Game Execution
    4. Website Materials (design, code, organisation, data and all other elements of the Site)
    5. Game Systems & Methods
    6. Software
    7. Computer Code
    8. “Look & Feel”
    9. Name
    10. Logo
    11. Branding
  2. All website materials are protected by copyright, trade mark, patent laws under all internal intellectual property laws.
  3. Subject to your compliance with the Terms, MRDRVRS grants you a worldwide, royalty-free license to use copy and display the purchased art for the following purposes only:
    1. For your own personal, non-commercial use
    2. Within a marketplace that permits the sale and purchase of your NFT.
  4. O protect the wider community and the value of the MRDRVRS brand, we reserve the right to remove the NFT from you in the event it is used in connection with damaging behaviour including:
    1. Extreme violence
    2. Hate crimes including but not limited to racism, bigotry, homophobia
  5. You acknowledge and agree that we retain the underlying copyright to enforce the above.
  6. You acknowledge and agree that these NFTs are not sold or represented to be a financial product.
  7. You acknowledge and agree that anything published by us is not in any way intended to be financial advice to you or others.
  8. You acknowledge and agree that NFTs are extremely volatile and could be deemed as worthless.
  9. You acknowledge and agree that we not provide any type of financial service.
  10. You acknowledge and agree that you are purchasing the NFT entirely at your own risk.
  11. You acknowledge and agree that you do not have a commercial license to use your artwork for commercial related endeavors.
  12. You acknowledge and agree that we reserve the right to update the Terms at any given time.
